Terms of Service

This Terms of Service ("Terms") is a legally binding agreement that governs your use of Chinese Zodiac Horoscope and services offered by Ectosoft LLC ("Ectosoft") at chinesezodiachoroscope.com (collectively, the "Service"). By using or accessing the Service, you agree to be bound by these Terms.

1. Access to the Service

a) Subject to your acceptance of these Terms, Ectosoft grants to you a non-exclusive, non-transferable, revocable limited license to use and display the Service for your personal non-commercial use. You agree not to use the Service for any other purpose, or to copy or distribute the content of the Service except as specifically allowed in this agreement.

b) Ectosoft reserves the right to change these Terms in any way and at any time. We will notify you of any modifications by posting the updated Terms on the Service. Your continued use of the Service after such notice shall be deemed an acceptance of any changes.

c) Ectosoft reserves the right to discontinue the Service or to change the content of the Service in any way and at any time, with or without notice to you, without liability.

d) Your use of the Service is conditioned upon your compliance with these Terms. Ectosoft reserves the right to terminate your access to the Service without notice if you violate these Terms.

e) You represent that you are 13 years old or older. Additionally, if you are between the ages of 13 and 18, you represent that your legal guardian has reviewed and agrees to the Terms.

2. Accounts and Authentication

a) The Service requires you to create an account using Google Sign-In, Apple Sign-In, or Email Magic Link. In creating your account, you agree to provide true, accurate, current and complete information about yourself and to maintain and promptly update such information to keep it true, accurate, current and complete.

b) You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You agree to immediately notify Ectosoft of any unauthorized use of your account.

c) Ectosoft reserves the right to terminate accounts that have been inactive for 365 consecutive days.

3. Purchases and Payments

a) The Service offers paid reports (Destiny Reports and Compatibility Reports) for purchase. All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service.

b) All prices are displayed in US Dollars. Prices may change at any time without notice, but changes will not affect purchases already completed.

c) Due to the digital nature of reports (generated instantly upon purchase), all sales are final. No refunds will be issued once a report has been generated. If you experience a technical issue preventing you from accessing a purchased report, please contact us and we will resolve the issue.

d) Promotional codes and discounts are subject to their own terms and may be revoked or modified at any time at Ectosoft's discretion.

4. Ownership of Intellectual Property

a) Unless otherwise specified in writing, all materials that are part of the Service are owned, controlled, or licensed by Ectosoft and are protected by law from unauthorized use. The entire contents of the Service are copyrighted under the United States copyright laws and/or similar laws of other jurisdictions.

b) You do not acquire any ownership rights by using the Service or by purchasing any reports or other digital goods.

c) You agree not to copy, redistribute, publish or otherwise exploit material from the Service, except as expressly permitted herein, without the express prior written permission of Ectosoft.

d) Purchased reports are for your personal use only. You may share report content informally (e.g., showing friends), but you may not reproduce, resell, or redistribute reports commercially.

5. User Content

a) The Service may allow you to submit content such as profile information, friend connections, and wall posts ("User Content"). Any material you transmit to Ectosoft will be treated as non-confidential and non-proprietary.

b) You agree that your User Content is wholly original to you and you exclusively own the rights to your User Content.

c) You grant to Ectosoft a non-exclusive, royalty-free, worldwide license to use, display, and distribute your User Content in connection with operating and improving the Service.

d) Ectosoft has no obligation to accept, display, review, monitor, or maintain any User Content. We have the right to delete User Content from the Service without notice for any reason at any time.

6. Usage Rules

As a condition of your use of the Service, you agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Post content that is offensive, defamatory, threatening, harassing, or obscene
  • Reveal personal information about another individual without their consent
  • Attempt to impersonate any other party
  • Create accounts by automated means or under false pretenses
  • Engage in any commercial activities through the Service without Ectosoft's written permission
  • Copy or adapt the Service's software, including but not limited to HTML, CSS, JavaScript, or server-side code
  • Reverse engineer, decompile, or attempt to discover any source code of the Service
  • Use automated systems (bots, scrapers, spiders) to access the Service
  • Interfere with or circumvent any security feature of the Service
  • Disseminate viruses, malware, or any other malicious code

7. Privacy

Ectosoft respects the privacy of visitors to our website. Your use of the Service is also subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding your personal information.

8. Disclaimers; Limitations of Liability

a) YOU EXPRESSLY AGREE THAT USE OF THE SERVICE IS AT YOUR SOLE RISK AND IS PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

b) The horoscope readings, zodiac calculations, and compatibility reports provided by the Service are for entertainment and informational purposes only. They should not be relied upon for making important life decisions. Ectosoft makes no claims regarding the accuracy or predictive value of astrological or zodiac-based content.

c) TO THE FULLEST EXTENT PERMITTED BY LAW, ECTOSOFT AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF, OR INABILITY TO USE, THE SERVICE.

d) UNDER NO CIRCUMSTANCES WILL ECTOSOFT BE LIABLE TO YOU FOR MORE THAN THE AMOUNT YOU HAVE PAID ECTOSOFT IN THE NINETY (90) DAYS IMMEDIATELY PRECEDING THE DATE ON WHICH YOU FIRST ASSERT ANY SUCH CLAIM.

9. Indemnification

You agree to defend, indemnify and hold harmless Ectosoft and its affiliates from and against all claims and expenses, including attorneys' fees and costs, arising out of your use of the Service and/or your breach or alleged breach of any term, condition, obligation, representation or warranty in these Terms.

10. Governing Law

a) This Agreement and all aspects of the Service shall be governed by and construed in accordance with the internal laws of the United States and the State of California, regardless of your location.

b) With respect to any disputes not subject to arbitration, you agree not to commence or prosecute any action other than in the state and federal courts located in San Francisco County, California, and you hereby consent to venue and jurisdiction in those courts.

c) Informal Negotiations. To expedite resolution and control the cost of any dispute, you and Ectosoft agree to first attempt to negotiate any dispute informally for at least thirty (30) days before initiating any arbitration or court proceeding.

d) Binding Arbitration. If you and Ectosoft are unable to resolve a dispute through informal negotiations, either party may elect to have the dispute finally and exclusively resolved by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association ("AAA"). YOU UNDERSTAND THAT ABSENT THIS PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL.

e) Class Action Waiver. You and Ectosoft agree that any arbitration shall be limited to the dispute between Ectosoft and you individually. No arbitration shall be joined with any other, and there is no right for any dispute to be arbitrated on a class-action basis.

11. Waiver and Severability

If any portion of these Terms is found illegal or unenforceable by any court of competent jurisdiction, such provision shall be ineffective to the extent of such determination without affecting the remaining provisions of the Terms, which shall continue to be in full force and effect.

12. Statute of Limitations

You and Ectosoft both agree that any claim or cause of action arising out of or related to use of the Service, these Terms, or the Privacy Policy must be filed within ONE (1) YEAR after such claim or cause of action arose or be forever barred.

13. DMCA Notices

If you believe that your copyrighted work has been copied without your authorization and is available on the Service in a way that may constitute copyright infringement, you may provide notice of your claim to Ectosoft's Designated Agent. For your notice to be effective, it must include:

  • A physical or electronic signature of a person authorized to act on behalf of the copyright owner
  • A description of the copyrighted work that you claim has been infringed
  • A description of where the material that you claim is infringing is located on the Service
  • Information sufficient to permit us to contact you (address, telephone number, email)
  • A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner
